Twenty-eight decrees to be issued, revised in the coming time
A mass of legal documents on land, construction, housing, and investment and business will be issued or revised in the last months of this year or first quarter of next year as announced in the list attached to Prime Minister Decision 1078/QD-TTg of July 25.
Accordingly, the PM asks related ministries and agencies to draft 28 government decrees on land, construction, environmental protection, and investment and business; amend 2 PM decisions on housing; and revise 22 ministerial circulars on land, construction, and investment and business.
The PM also sets deadlines for submitting these draft documents to the Government, PM, or ministers or heads of ministerial-level agencies for promulgation.
Specifically, in the third quarter of 2017, the assigned agencies will have to submit a draft decree replacing Decree 73 of 2012 on foreign cooperation and investment in education, a draft decree replacing Decree 19 of 2016 on gas trading, and a draft decree revising Decree 72 of 2013 on management, provision and use of Internet services and online information, among others.
In the last quarter of this year, competent agencies must submit draft decrees concerning environmental protection master plan, strategic environmental assessment, environmental impact assessment and environmental protection plan; mineral exploitation and trading; organization and operation of people’s credit funds; and gold trading management.
Meanwhile, draft decrees on land, sanctioning of land-related administrative violations, land price brackets, construction contracts, electricity safety, enterprise registration, investment, and industrial property will be submitted in the first quarter of 2018.
The PM instructs ministers and heads of ministerial-level agencies in charge of drafting the above documents to assign personnel and allocate funds to ensure their quality and schedule, and submit them to the Government or PM for promulgation or promulgate according to their competence in compliance with the 2015 Law on Laws.
Agencies in charge of drafting will closely coordinate with the Ministry of Justice and Government Office in formulating a plan on drafting, appraisal, verification and submission for every of the listed legal documents. They will also have to assign tasks to and define responsibilities of agencies, units and heads of these agencies and units in the formulation and submission of legal documents.
Particularly, the above deadlines will not be extended, except special cases to be decided by the PM.
The Ministry of Justice and Government Office will appoint their officers to participate in drafting and adjusting the above documents and monitor the whole process of document formulation and submission, with priority given to accelerating the appraisal and verification of documents.- (VLLF)
